Thank you for visiting the Web site for Halp, Inc. (“Halp”) Your privacy is important to us. As such, we provide this privacy policy (“Privacy Policy”) explaining our information practices and the choices you can make about the way your information is collected and used on halp.com, bubbleiq.com, and any affiliated Web sites, services, or applications (together the “Halp Services” or “Services”).

For purposes of this Privacy Policy, references to Halp Services or Services shall mean the Web sites bearing the URLs halp.com, bubbleiq.com, and any affiliated Web sites, services or applications. References to “we,” “our,” and “us” mean Halp, Inc. References to “you” and “your” mean the user of Halp Services. We collect information in the context of our business relationships with our customers and potential customers.

By using Halp Web sites, services or applications, you represent that you have read and understand the Privacy Policy and that you consent to the processing of your Personal Data as set forth below.

Please read the Privacy Policy carefully to understand our practices regarding your Personal Data and how we will treat it.  Please pay particular attention to the sections entitled “International Transfer” and “Your Rights.”

2. What is personal data?  We collect information about you in a range of forms, including Personal Data.  As used in this Privacy Policy, “Personal Data” means any information which, either alone or in combination with other information we hold about you, identifies you, including, for example, your name, postal address, email address and telephone number or any other information defined as “personal data” or “personal information” under the General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679) or the California Consumer Privacy Act of 2018 (CCPA) (Cal. Civ. Code §§ 1798.100-1798.199).

3. Why do we need your personal data?  We need certain Personal Data in order to deliver the Services to you.

4. Your consent.  By registering with Halp Services or submitting Personal Data through our Services, you expressly consent to the collection, use and disclosure of your Personal Data in accordance with this Privacy Policy.  We will process your Personal Data in accordance with applicable data protection and privacy laws.  When you register with us, you are required to consent to our Privacy Policy.  This consent provides us with a legal basis under applicable law to process your Personal Data. You maintain the right to withdraw such consent at any time.

5. The information we collect.

We use your Personal Data to provide you with the information or content that you have requested, and, in some cases, to contact you about our products, features or services. If you no longer wish to receive press releases or any other type of information from us, you may send us an email through our “Contact Us” link to change your preferences; or follow the “unsubscribe” link provided in the e-mail that you receive.

We use non-identifying information collected through Halp Services in the aggregate to better understand your use of our services and to enhance your enjoyment and experience. For example, we may use the information to improve the design and content of our services or to analyze the services that we offer.

We may employ other companies and individuals to perform functions on our behalf. Our employees, agents and contractors who have access to Personal Data are required to protect the information in a manner that is consistent with this Privacy Policy.

6. Automatic data collection.

Account and Profile Information. In order to use our services, we collect data from you through the use of our bot including but not limited to: name, avatar(s), email address, employer, title, permission settings and preferences.

IP Address.  To make Halp Services more useful to you, our servers (which may be hosted by a third-party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.  We may associate your IP address with your account and your other Personal Data.

Log Files.  As is true of most websites, we gather certain information automatically and store it in log files.  This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data.  We use this information to analyze trends, administer the Services, track users’ movements around the Site or the App, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs.  For example, some of the information may be collected so that when you visit the Site or use the App again, it will recognize you and provide other information, support or Services tailored to your user needs.  Except as noted in this Privacy Policy, we do not link this automatically-collected data to Personal Data. 

Cookies.  Like many online services, we use cookies to collect information.  “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website.  We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience of our Services.

We use two broad categories of cookies: (1) first party cookies, served directly by us to your computer or mobile device, which are used only by us to recognize your computer or mobile device when it revisits our Services; and (2) third party cookies, which are served by service providers on our Services, and can be used by such service providers to recognize your computer or mobile device when it visits other websites.

Social Media Cookies

Analytics.  We may use third-party analytics providers (like Google Analytics) to help analyze how users use the Services.  These analytics providers use cookies and other technologies to collect information such as how often users use the Services, what pages they visit, and what other sites they used prior to coming to the Site. We use the information we get from these providers only to improve the Services. They collect the IP address assigned to you on the date you visit the Site or use the App, rather than your name or other personally identifying information.  We do not combine the information generated through the use of such analytics with your Personal Data. Although such services may set persistent cookies on computer to identify you as a unique user the next time you visit the Site, the cookie is designed to be used only by the service provider.

We use cookies to understand site and Internet usage and to improve or customize the content, offerings or advertisements on our site. We also may use cookies to help us offer you products, programs, or services that may be of interest to you and to deliver relevant advertising.

We, our third-party service providers, advertisers or our partners also may use cookies to manage and measure the performance of advertisements displayed on or delivered by us and/or other networks or sites. This also helps us, our service providers and partners provide more relevant advertising.

We, our third party service providers, advertiser or our partners may also use “web beacons” or clear .gifs, or similar technologies, which are small pieces of code placed on a web page, to monitor the behavior and collect data about the visitors viewing a web page. For example, web beacons may be used to count the users who visit a web page or to deliver a cookie to the browser of a visitor viewing that page.

7. Information you provide to us. We ask for information necessary to providing our services and billing for those services.

We ask for and may collect Personal Data about you such as your name, address, phone number, email address, instant messaging ID, company name and website name, when you register for an account to access or utilize one or more of our Services. We also ask for and collect Personal Data such as an email address and a name or alias from any individual that you authorize to utilize our Services in connection with your account (an “Agent”). We base the processing of your Personal Data on our legitimate interest to provide you with the necessary functionality required during your use of our Service(s).

If you sign-up for a free trial Account, you are not required to enter your credit card information unless and until you decide to continue with a paid subscription to our Services. A third-party intermediary is used to manage credit card processing. 

We also collect and store content that you post, send, receive and share through our services. This content could include Personal Data about you or others in your workspace(s) or instance(s). Personal Data could also be included in files, screenshots, comments, custom emojis and links you use with or upload to the Services.

We refer to any information described above as “Account Information” for the purposes of this Privacy Policy. By voluntarily providing us with Account Information, you represent that you are the owner of such Personal Data or otherwise have the requisite consent to provide it to us.

Halp offers or may offer publicly accessible blogs, community forums, comments, discussion forums, or other community engagement (“Community”). You should be aware that any information that you post in a Community might be read, collected, and used by others who access it. To request removal of your Personal Data from a Community, contact us at support@halp.com. In some cases, we may not be able to remove your Personal Data, in which case we will let you know if we are unable to do so and why.

8. Disclosure of your Personal Data.  We disclose your Personal Data as described below and as described elsewhere in this Privacy Policy.

Third-Party Service Providers.  We may share your Personal Data with third-party service providers, for example: to our integration partners in connection with your use of the Services, to otherwise provide you with the Services; to conduct quality assurance testing; to improve and build the product; and to provide technical support. Here is a list of our third-party service providers with access to Personal Data: halp.com/subprocessors.

Contractors, Agents, and Partners. We may share your Personal Data with contractors, agents, or partners who from time to time augment our capacity in various ways in which case we will require our contractors, agents and partners to honor this Privacy Policy. 

 Corporate Customers. If your access to the Services is associate with a corporate customer of Halp, we may share your Personal Data with such corporate customer for billing and administrative purposes.

Affiliates.  We may share some or all of your Personal Data with our subsidiaries, joint ventures, or other companies under a common control (“Affiliates”), in which case we will require our Affiliates to honor this Privacy Policy. 

Corporate Restructuring.  We may share some or all of your Personal Data in connection with or during negotiation of any merger, financing, acquisition or dissolution transaction or proceeding involving sale, transfer, divestiture, or disclosure of all or a portion of our business or assets.  In the event of an insolvency, bankruptcy, or receivership, Personal Data may also be transferred as a business asset. If another company acquires our shares, business, or assets, that company will possess the Personal Data collected by us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy.

Other Disclosures.  Regardless of any choices you make regarding your Personal Data (as described below), We may disclose Personal Data (a) in connection with any legal investigation; (b) to comply with relevant laws or to respond to subpoenas or warrants served on Halp; (c) to protect or defend the rights or property of Halp or users of Halp Services; and/or (d) to investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Service.

9. Rights of European users.  The information provided in this section applies only to individuals in Europe. If you wish to exercise any of the following rights, please contact us at support@halp.com. In your request, please make clear: (i) what Personal Data is concerned; and (ii) which of the rights you would like to enforce.  For your protection, we may only implement requests with respect to the Personal Data associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable and in any event, within one month of your request. Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such change or deletion.

Opt-out.  You may contact us anytime to opt-out of: (i) direct marketing communications; (ii) automated decision-making and/or profiling; (iii) our collection of sensitive Personal Data; (iv) any new processing of your Personal Data that we may carry out beyond the original purpose; or (v) the transfer of your Personal Data outside the EEA. Please note that your use of some of the Services may be ineffective upon opt-out.  Despite your indicated e-mail preferences, we may send you service-related communications, including notices of any updates to our Terms of Use or Privacy Policy.

Access. You may access the information we hold about you at any time via your Member Account, where applicable, or by contacting us directly.

Amend. You can also contact us to update or correct any inaccuracies in your Personal Data.

Move. Your Personal Data is portable – i.e. you to have the flexibility to move your data to other service providers as you wish.

Erase and forget. In certain situations, for example when the information we hold about you is no longer relevant or is incorrect, you can request that we erase your data.

File a complaint. You have the right to lodge a complaint against our practices with respect to your Personal Data.

Information.  To request that we disclose the following information about our collection and use of your Personal Data during the past 12 months:

  • The categories of Personal Data that we have collected about you;
  • The categories of sources from which Personal Data is collected;
  • The business or commercial purpose for collecting or selling Personal Data;
  • The categories of third parties with whom we share your Personal Data;
  • Whether we have disclosed your Personal Data for a business purpose, and if so, the categories of Personal Data received by each category of recipient; and
  • Whether we have sold your Personal Data, and, if so, the categories of Personal Data received by each category of recipient.

Access.  To request a copy of the Personal Data that we have collected about you during the past 12 months.

Deletion.  To request that we delete Personal Data about you that we have collected from you.

Opt out of sales.  To direct us not to sell your Personal Data if we do, and if you are under 16 years of age, we are required to ask for affirmative authorization from you (or it you are under 13, your parent or guardian) to sell your Personal Data before we do so.

Nondiscrimination. To exercise your rights described above free from discrimination, such as denial of goods or services; price/rate increases for goods or services (including through grants of discounts/benefits or imposing penalties); decreases in service quality; or suggesting that such discriminatory acts may occur if you exercise your rights.  However, a difference in price or service quality is not discriminatory if reasonably related to the value to our business of the Personal Data we are unable to use due to the exercise of your rights, and we may offer you certain financial incentives that can result in different prices, rates or service quality.

Financial incentive program disclosures.  Receive a clear description of the material terms of any program involving financial incentives for the collection, sale or deletion of your Personal Data, and decide if you want to consent to be entered in it (you can revoke this consent at any time).

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable request related to your Personal Data.

  • Provide sufficient information that allows us to reasonably verify you are a California resident about whom we collected Personal Data or their authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

These rights are not absolute, are subject to exceptions, and we may be required or permitted by law to decline your request.

11. Data Security. We take reasonable steps to maintain the security of the Personal Data that we collect. However, no data transmission over the Internet can be guaranteed to be completely secure. Accordingly, we cannot ensure or warrant the security of any information that you transmit to us, so you do so at your own risk.

12. International Transfer. This Services are hosted in the United States of America and subject to applicable U.S. Federal and state laws, rules and regulations. Your Personal Data, may be transferred to, stored at and processed by us and our affiliates and other third parties outside the country in which you reside, including, but not limited to the United States, where data protection and privacy regulations may not offer the same level of protection as in your country.  By using our Service, you consent and agree to this transfer, storing, processing and use of your Personal Data in accordance with this Privacy Policy.

We comply with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Data transferred from the European Union and Switzerland to the United States. We have certified to the Department of Commerce that we adhere to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. The Privacy Shield Principles require that we remain potentially liable if any third party processing Personal Data on our behalf fails to comply with these Privacy Shield Principles (except to the extent we are not responsible for the event giving rise to any alleged damage). Our compliance with the Privacy Shield is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission. If you do not receive timely acknowledgment of your Privacy Shield-related complaint from us, or if we have not resolved your complaint, you may also resolve a Privacy Shield-related complaint through JAMS, an alternative dispute resolution provider located in the United States. You can visit https://jamsadr.com/eu-us-privacy-shield for more information or to file a complaint, at no cost to you. Under certain conditions, you may also be entitled to invoke binding arbitration for complaints not resolved by other means.

13. Halp as a Data Processor/Service Provider. We may collect, use and disclose certain information about you when acting as our customer’s service provider. Our customers are responsible for making sure that your privacy rights are respected, including ensuring appropriate disclosures about third party data collection and use. To the extent that we are acting as a customer’s data processor, we will process your information, including any Personal Data, in accordance with the terms of our agreement with the applicable customer and the customer’s lawful instructions and the terms of this Privacy Policy shall not apply to such processing.

14. How to contact us. We are committed to resolve any complaints about our collection or use of your Personal Data. If you would like to make a complaint regarding this Privacy Policy or our practices in relation to your Personal Data, please contact us at: support@halp.com. We will reply to your complaint as soon as we can and in any event, within 45 days. We hope to resolve any complaint brought to our attention, however if you feel that your complaint has not been adequately resolved, you reserve the right to contact your local data protection supervisory authority.

15. Updates and modifications. From time to time, we may update this Privacy Policy. We will notify you about material changes in the way we treat Personal Data by sending an email message to the email address you most recently provided to us or by prominently posting a notice on our Web site(s). We encourage you to periodically check back and review this statement so that you always will know what information we collect, how we use it, and with whom we share it. We may modify, add to, suspend or delete the Privacy Policy, in whole or in part, at our sole discretion at any time, with such modifications, additions or deletions being immediately effective upon their posting to the Web site. Your use of Halp Services after modification, addition or deletion of the Privacy Policy shall be deemed to constitute acceptance by you of the modification, addition or deletion.
